Need to get out of my contract!! would have been fine if we closed on schedule (summer 08) but can't close now. any suggestion?

Speak to your attorney. Search the discussions for "contract" - there are a number of threads dealing with this same issue.

Thanks for your quick response. I was hoping to get an answer from someone who got out of their contract in the building and how to do it. thanks anyway...

You can probably get out of your contract pretty easily if you are willing to forfeit your deposit. All things considered, it might be a reasonable (though painful) price to pay.

I don't know about Urban Green specifically, but I do know that some people have gotten out of their contract AND recovered some or all of their deposit - but this depends on the specific facts involved. For example, you could have (i) delay in closing past a certain date which triggers a rescission right, (ii) lack of disclosure and/or misrepresentations in the offering plan, (iii) material change in the construction as compared to the plan, (iv) failure to obtain a mortgage within the mortgage contingency period, (v) failure to obtain financing even AFTER your mortgage contingency period has expire) (although this one may be a legal gray area), and (vi) any other rescission rights that might be buried in the fine print of the plan or contract. Make sure your attorney is a fighter.

The offering plan clearly states that you can ask for a full refund of your deposit after 1 full year has passed from the prospective first closing date. The date they have listed in the offering plan is Sepetember 7th 2007.1 year would be have been 9/7/2008. The contract states a different date however the contract also states the the offering plan trumps the contract shoud any dispute arise. Have your attorney earn his money and re read the contract and the offering plan. The answer is there for all to see.

With some price cutting at 58 met and less open, but concessions at other developments, WB developers are finally moving along a bit. Is Urban Green joining the party?

The building has been resurrected. Lots of activity lately and now marketed as Jardin Condos (aptsandlofts)
