Hey, everyone. I'd love anyone's advice on this, so thanks in advance if you'll kindly take a moment.
I've owned a co-op apartment in midtown for 10 years. I occupied it for 7 and have sublet it out for the past 2.5. The managing company accidentally neglected charge me sublet fees for 2 years and I have had an ongoing dispute about how much I owe. When I first sublet the apartment the house rules stated it was $150 a month, but sometime in the months that followed it changed to $175.
My question is, should the board be held to charging the $150 monthly fee that was in place when I entered into the sublet agreement or do they get to change the amount midstream to suit their new house rules?
It rather seems it's the latter as they really seem to do whatever they want. I just would like to know if it's actually legal and whether it's worth fighting in small claims court or somesuch.
