What are the buyers rights when a NYC new development is delayed? Do they have to wait for the developer to offer a rescission notice first? Thanks in advance

You should probably talk to your lawyer. If you know that the financials are stale and you have to be offered a right to rescind, then I don't see any harm in sending a letter asking for your deposit back, but your lawyer would know better.
