Marijuana Smoke Coming thru Ventilation System

Hi, Recently moved into a new condo building and rent directly from the owner. Since we have moved in, on a almost daily basis, there is not just an odor, but actual weed smoke coming thru the ventilation system. Have contacted the Management company numerous times to no avail. They have told us to call the cops and that they are working on it. Next step is notifying the landlord, packing my shit, moving out and hiring a lawyer. Assuming the management company will have the same issue with the new tenant who ends up occupying my apartment, why wouldnt these twunts just deal with the problem and get it fixed instead of having to deal with this over and over again?

you dont have significant reason to break a lease. Feel free to move out but you will lose your security deposit and your landlord has the right to sue you for damages, as well as, to ruin your credit rating.

As I mentioned there, a Related super posted a really helpful rundown this weekend of all the physical measures he takes to resolve a secondhand smoke complaint, like putting a piece of charcoal filter in all exhaust/fresh air supply grills; spraying foam insulation in various nooks and crannies; caulking etc. (To read the whole thing, scroll to the bottom of http://www.brickunderground.com/forum/my_building/neighbor_relations/neighbor_who_smokes)

did you notify the landlord/owner to have him work with the building to resolve? Start your paper trail, document everything.

The owner will just rent it to someone with asthma at a premium...

Several studies have shown that THC acts as a bronchodilator in both normal subjects and patients with either chronic bronchial asthma or experimentally induced bronchial spasms. Since irritating effects of THC and tars in marijuana smoke have the potential to produce chronic bronchitis in heavy users, it may seem surprising that many people with asthma find smoked marijuana useful. Apparently the bronchodilator effects outweigh the irritation for some patients.

A team from Hungary has conducted research into marijuana and established a link between the drug and asthma which could help develop new treatments for respiratory-related illnesses. Back in the mid-1970s US professor Donald P Taskin found that "recent studies demonstrated significant, acute bronchodilation in healthy young men after they smoked marijuana".
Now research in Hungary, Italy and the US indicates that while some asthma sufferers are prone to coughing when exposed to elements of the drug, others seem to be less affected by such irritation when lung muscles are tensed.

According to Dr Tamás Freund of the Institute of Experimental Medicine of Budapest, the knowledge gleaned from this research could alter the way respiratory illnesses are treated.
"Colleagues at the University of California, Irvine, found that induced bronchular constriction was antagonized by anandamide, a substance with the same properties as cannabinoids, a material found in marijuana.
"The contribution of my laboratory was to localize the molecules released by anandamide and its effect on nerve fibers in order to ease the muscles, helping reduce the substance that constricts the muscles," he explained.
Marijuana is currently being examined for medical properties in the fields of asthma, stroke and cancer research, as well as being utilized for pain relief and the control of nausea and vomiting associated with chemotherapy treatment.
Freund and his staff of researchers have completed their part of the project, but say the day drugs utilizing their work are widely available to help asthma sufferers is still some way off in the future.
"This is the basic research, more study is required before drugs can be made available," said Freund. At present the research has involved animals, but in the US research is soon to be conducted on humans.
Danielle Piomelli, of the University of California, said, "We think that by targeting cannabinoid receptors in the upper airways we can control coughs in a number of conditions."
For the moment, the Institute of Experimental Medicine is now continuing its work with marijuana based substances, examining the link between learning and memory.

@gcondo - im sending the landlord all the correspondence with the langer from the management company today. They are completely useless.

@petrfitz - I guess that remains for a judge to determine. And since my company pays all my legal costs associated with tenant landlord disputes, I have no problem spending their money to do so. Something tells me that weed smoke coming into my apartment via what is supposed to be an exhaust system in a brand new building might be reason enough to break my lease.

Do you know where the smoke comes from? Our old neighbor used to smoke in bed, watching TV. His bedroom was sharing a wall with ours ( the 2 apartments are pretty much mirror images.)
I went to talk to him during the day, in a friendly way, letting him know that the smoke found its way to our bedroom. We put extra insulation around the sockets in that wall, he started opening his window, and the problem pretty much went away ( except if I opened my window at night.)

why don't you try talking to your neighbors or putting up a sign inm the lobby. might be the most effective with the least effort.

petrfitz: this case is a textbook warranty of habitability issue. Smoke from an illegal substance coming in through the vent will win this case in favor of the tenant in about 5 seconds. By the way, false credit reporting can be a crime (depending on circumstances).

Yahweh: you should definitely call the police. Document date(s) and time(s). An start a paper trail. You should also talk to an ambulance-chaser to see if there is a liability case against your landlord that they may be willing to take on a contingency fee. Best of luck, let me know how it ends.

You are getting completely bad information. 1 - you have to prove through documentation that you not only have an issue, but that you have properly notified the owner and the management. 2 - you have to prove that the owner and/or management company has recieved the notifications and either did not comply within a reasonable time and/or did not comply at all, 3 - you need to prove that the smoke actually happens, and that it is an issue and that your lease allows you to break for this specific reason.

Do not listen to the people who tell you to just walk away. It is not that easy. Although you may have your costs covered, there are other implications to you personally that you should be aware of.

Just do it properly, give concerned parties a chance to fix and you will make your life much easier.

Or you could listen to ukrguy who is telling you the easy way out, or you could listen to me a landlord with actual experience in this situation.

ive called the cops a few times and documented it.

ive called and emailed the management company and the doorman/maintenance crew every single day for the past month.

ive emailed the unit owner and let him know the lack of response so far and will give him a chance to sort it out

based on his response i will most likely hire a lawyer thru work to deal with it going forward as I dont have the time or patience to deal with it anymore

petrfitz: read carefully the opening posting in this thread. Yahweh already mentioned that he notified the mgmt company more than once to no avail. I would never recommend anyone just walk away from an apartment w/out first documenting all problems and giving the l-lord a chance to fix it. The problem is that in this case, despite multiple requests, mgmt company has not produced tangible results. Yahweh's case here is strengthened by the fact that it is an illegal substance that is being smoked. Based on the info that Yahweh has provided so far, he/she seems to have a very strong case.

ARE YOU KIDDING ME??? There is so much worse than that? Is the neighbor loud or abnoxious? I mean if they are not, how is that different from someone complaining about bad food coming out of an apartment? Does my sister get to walk from her lease because she lives in Chinatown and it smells like dirty fish 24/7?

I think people are way too uptight! In the past 10 years I have lived in NYC, the city's "attitude" reminds me of my visits to Kansas City to meet my parents (except there no one would complain)...

I don't know if I can render an opinion on this without visiting the apartment several times to see if, in fact, the second hand pot smoke is intoxicating. I'll be over around 10. Have some snacks ready ...

What about adopting retired drug sniffing hound from US Customs and Border patrol? That dog will go absolutely bananas at 4:20 everyday and you can make a deal with Cheech and Chong. No more Hooka, no more Hound. Problem solved. If that doesn't work, come over to my place, my Eastern Indian neighbor makes a retched fish dish every Friday evening, I'm sure she'll give you the recipe, and you'll have another negotiating chip without having to pick up poop 3 times a day.

You live in NYC! Get over it prude. If you cant deal with weird smells, noise and bad neighbors move to the burbs!

Wouldn't just having a few friends over, who could sign affidavits that they witnessed the smoke also, take care of that part of the problem? It seems like it doesn't have to be just "your word against the neighbors," when it's so easily established by getting other people to corroborate.
