Offering Plan and Financials Fee

I'm in the process of signing a contract on a Condo resale and my attorney needs the offering plan, financials, and a questionnaire. Sellers broker has informed me that the cost of the questionnaire and offering plan will be $100 each and $10/year for the financials. Am I supposed to pay these fees or the seller?

seller or seller's broker provides the financials and offering plan for due dilligence. not you at all. Mortgage questionaire is your cost.

Broker should have these items as soon as they get the signed exclusive.

direct from sponsor they may ask you to pay a deposit for OP, but re-sale is seller responsibility all the way

Sigh, I figured as much. I have a feeling that the seller's broker has no idea what they are doing. We had an accepted offer as of 4/28 and still not offering plan/financials nor a response to the contract changes my lawyer requested.

Sigh, the seller's broker knows exactly what they are doing, you don't. Wake up! They're shopping the deal around to get a better price. Pull your offer, telling them that they don't seem serious and that they're shopping your price around, and that you're moving forward with another option. Do not disclose your other option, which is to keep looking.

Use their ensuing panic for leverage.

I'm with inonada, mostly. The sellers are taking say too long, trackcutie.

But you don't have to pull your offer if you still want the apartment, you only have to threaten to do so--um, today. ;) Also, if I were you I would keep looking and be poised to move on to something else, you're not done yet.

Regarding that questionnaire, this might be a mandatory inspection of the apartment questionnaire? I'm not sure what else that could be, if the seller's broker is telling you about it and it costs $100. If so, that's the seller's cost as well.

It's also a little red flag that the seller's broker even suggests that you should pay these expenses, which are not high, in my experience. Sounds to me like they aren't happy with the accepted offer.

the only $100 fee that you would be expected to pay is to have your appraiser's questioneer filled out. the rest are to be provided by the seller as everyone else stated. having contract negotiations for 3 weeks is a red flag. it is possible that the financials were not that good and they expect the ones for 2009 to be better. they may not be ready yet, but will be within the next few days/weeks/months.

I know they hate our offer. After countering back and forth, we made an offer which the seller was too low, countered with the same price firm and we walked. The next day the broker called us back and told us the they were convinced to accept our offer.

I believe when I bought a condo there was a refundable $100 deposit for the offering plan. Why they don't just telex the PDF instead is beyond me ... maybe it lacks gravitas.

Talked to them today, lawyer should have the offering plan and financials by tomorrow. Getting inspection done tomorrow. Hopefully the ball is rolling. First-time buyer here buying sans broker and very non-confrontational. Thanks everyone for the kick.
