Considering making an offer to an apt(2nd floor) on the second floor. There's vacant restaurant(1st floor) right below... Broker said they cannot get any liquor license because of the school(within 200). Any idea?
Even without a liquor license, it's noisy living upstairs from a restaurant.
Lots of cooking odors.
The rules about the liquor license proximty to schools and houses of worship are, like most rules, technical. I recall for instance that Schillers avoided it by moving the entry door. Also, I believe the porhibition only applies to a full license, not to beer and wine.
do not believe the broker...assume they will have ll and proceed as such.
Can't remember how many times I have been told that "they won't build on that empty lot becasue xyz" only to see years later that they have
Case in point, looked at a low floor apt opposite The Tunnel Garage in soho and when mentioned the concern of construction on the site, the broker said not to worry, it is like a landmark, they will never build there...but they did!!!
Oy--I'd be very wary of purchasing a unit right above a restaurant. Smells, vermin, noise--probably best to stay away. Just my .02.

bramstar: I didn't include the vermin problem in my comment. But the roaches and critters have been having an "open house" at that vacant restaurant storefront location.
How long has it been vacant? Oy, for sure.
