My mother Past away a couple of years ago and I succeeded the apartment even though the landlord refused to place me on the lease. While my mother was still alive we found out the apartment had no COO while preparing to go to court for other issues in the apartment IE the ceiling collapsing 2 times in my bathroom and the ceiling in one of my closets has a gaping hole in it that has yet to be fixed in 4 years. At This time in 2007 my mother went to court. I have recently come across some paper work from the court stating that the landlord of my building was suppose to give us a 2 bedroom for no less than 1000 dollars. Currently I would like to move out but I dont want to make it so easy for the Landlord. They used to send rent statements to my apartment for 3 months after my mother died nothing in my name though since they refused to place me on the lease. Now we are in 2011 and I have not recieved a letter a call a rent statement nothing at all from the building, I would of thought I would of gotten an eviction noticed but I did not even get that. Since It seems like the landlord is letting me "squat" what should I do? My family has rented this apartment since the 60's and as we discovered it was never suppose to be an apartment. It is actually suppose to be an doctors office. I want to improve my living situation but not just give up a 2 bedroom apartment when I should be have a 2 bedroom for under 1000 in Manhattan. This is a Large landlord (vantage Management) and I live in their building in The Savoy. Is their anything I can do? [less]

I'm not a lawyer, and you should seek legal advice rather than advice on a discussion board, so take mine with a grain of salt.
You should be putting that money into an escrow account, until a formal written legal settlement or judgment. You're entitled to succeed your mother if you were living in the apartment with her for two years prior to her death.

If you ask anyone with some social conscience, they will give you the same advice.
Why force yourself into a situation that you don't enjoy. Except may be potentially brag about paying "only" one thousand dollars for a 2 bedroom in Manhattan.
Of course, if you get paid legal advices, then the lawyers will tell you a different story. Grow up.

bravo, alan. best response you ever posted on se - agree with alan completely, you need to seek counsel here. You can probably get pro bono advice here too if need be and by contacting one of the large nyc firms.

I want to add that just because it's supposed to be a doctor's office doesn't (necessarily) mean that it's not habitable as an apartment, nor that it's not covered by rent stabilization. And it MIGHT even be possible that your landlord has forfeited his right to increases under rent stabilization to date. So you might enjoy staying there. It's a nice complex, regardless of your landlord's other sloppy moves.
