Just got a great offer on my apt in NYC. I have a tenant living there and lease is up June 30th. Can I ask her to leave by april 30th? the buyer wants to move in may 1st...

Are you willing to double or triple the deposit that will be returned to the tenant?

If the tenant is in good standing, and you are unwilling to buy out her lease, she is staying there until June 30th.

the tenant has lawful choice to stay there and continue paying the same rent.

if you don't agree, you could reject his/her/their rent check for 3 months in a row, then you are entitled to go to court to evict the tenant. if you never harras/abuse the tenant, then certainly the court will rule in favor of you and order the tenant to leave in months.

Buyer thinks s/he is going to close in 5 weeks? Co-op/Condo? Mortgage??

You should probably be worried about whether the tenant leaves at the end of the lease, much less two months early.

Of course you can ask your tenant to leave.

I'm with Sunday, since this is very last-minute, this is going to cost you some cash.

i just read the lease and found that it states I need to give tenant 30 days notice in case of sale. which I will do! thanks everyone!

"In case of sale" means after contract is signed or after closing?
