Roommates in Co-ops

I've been reading through all the previous discussions on this. There is conflicting information. After I buy a co-op can I have my friend move in with me without asking or telling anyone? Thanks.

1. you should check the provisions of your lease that concern guests
2. there was an appellate decision on that issue years ago by the First Department
3. by law tenants can have one unrelated person live with them
4. but caselaw has held that Coop leases can ciecumscribe owners rights
5. I recoemmend that you consult a knowledge landlord-tenant attorney about your question

I've seen coop rules where only the purchasers of the shares are legal tenants in the proprietary lease along with immediate family/births (children) in the family. Extended guests are usually limited to 30 days without notification to the board in which case has the right to make the decision.

All that matters is NY law. And that law apparently says ALL coop owners have the right to a roomate - ANY roomate as long as you both live there. Let a board try to enforce such a rule and take action against an owner and see how far they get.

It must be the primary residence of the shareholder.
That's the "Room Mate" law.

That only counts within your own building. Outside of your building, you are nobody.
