I've been trying to find an attorney to do due diligence towards a closing on an HDFC apartment. I had some extra questions and research for them, and we negotiated a fee. I finally found someone who seemed very smart. But she has completely disappeared. She wanted me to sign a retainer, and said she would sent it along "shortly" after checking for a conflict of interests with the building. That was on Monday. On Tuesday we were still on email. Then the line went dead. Should I take this silence as a change of heart and start the process of looking all over again? I'm trying to close by early Dec.
If you get a lawyer with a flat fee they will disappear often. If you pay them hourly they will be very responsive. If you hire someone from a small shop they might legitimately be busy and have a hard time responding to none urgent matters. If she has been MIA for a few days you should move on and fund someone who meets your expectations in terms of responsiveness, which you will pay for.

I have been dealing with RE purchases and headaches. My primary residential condo RE attorney was so-so. However, the one I am using now who does all kinds of RE legal matters has been solid and responsive to urgent matters. His name is Keith Balis, RE attorney in Greenpoint, Brooklyn, NY. He wears different hats but manages to provide very good client service. Google him and let him know what you need upfront and see if he can take on your case. He is a busy person but he does the job and operates from the old school model (which I prefer) in terms of allowing the client to discuss issues of concern and ways to handle problem issues as they arise. He is very decent person and pricing is very fair. Good luck to you!

Gelleresque -- follow exactly what Ottowanyc said. Your situation requires a greater level of due diligence as well as potential risk exposure for the attorney. You need to find a by the hour person or tell any attorney generally charges a flat fee, you'll pay them by the hour. Overall, one of the main topics currently among brokers is just how bad real estate attorneys have gotten in recent years. Not much other wisdom I can offer aside from saying it's going to cost you 2 or 3 times ($4500-$6000) more than the standard $2k for a transaction fee. However, you can just factor the cost into the likely below market price you might pay for an HDFC apartment.
Most real estate attorneys charge flat fees. There are just as many issues in some land lease buildings as there are in your case. The easy condo cases compensate for the more complicated ones. Also, there aren't many really good attorneys for residential transactions, the better ones often just start out with a higher flat fee to cover such issues, and you pay either way. I had two that I thought were mediocre to awful, but I really liked Bonnie Covey. She was very bright, on top of things and not condescending at all (some real estate attorneys, particularly at the high end, seem rather defensive about their chosen profession).

Yes, most are only adequate at best. Luckily that's enough for most people. There are very few really good ones. You get what you pay for, and in the NYC world of law this is low pay for anything requiring any extra work, so most are loath to do it.

Thanks for the helpful responses. I would have taken this advice except that strangely enough the attorney contacted me about 20 minutes after I posted this. I signed the agreement and then we had a long and informative conversation. I'm extremely impressed so far. She is usually a by the hour attorney but we negotiated her fee based on my income and the sense that all parties had been super cooperative with each other so far.
