what is the deal with brokers responding to fsbo's?

why is it that when somebody places an ad for a fsbo (for sale by owner) and clearly states no borkers. every real estate broker in nyc calls and emails.........what is it that they dont understand.?

that there is nothing to lose I guess. Part of the frustration of doing it yourself is that you will have to deal with brokers whose business model is to call FSBO's, and hope that out of 75 brokers that call them, they get the listing!

would i be legally obligated to pay a broker if he/she leads me to a properties which i find later was a FSBO?

No...there is no such thing as buyer loyalty and I assume you did not sign anything that states as such. I worked plenty of buyers who never ended up buying; part of the business. The buyer broker should know before hand that FSBO who do not work with brokers, is not offering any commission to them. So, they should understand that discouraging you not to buy that place because they dont get paid is pretty stupid as it shows where their interest is. If my clients find a FSBO who are not working with brokers, I tell them to view on their own and that my services would not be offered for property valuation, comps analysis, bidding strategy or negotiating during buy side process.

I work for a living and so do all brokers. But you would not be legally obligated to pay out any commissions to buy side broker in this case, as long as you didnt sign anything that states you do. I dont get why this broker would lead you to a FSBO who is not paying out a buy side fee in the first place.

digs, I assume you offer consulting services for a flat rate? I have seen some folks go the FSBO route and use their broker for comp analysis, bidding strategy, etc for a flat or hourly rate. I'm not sure how excited brokers are about doing this, but may be better than nothing?

What about if it is FSBO, but the owner states they would pay a buyer's broker commission? Does that change things? Or is it just about if you had signed an agreement for the broker to represent you? I suspect it's the latter but wanted to make sure.

i listed the apartment last week and have already recieved 15 phone calls and 20 emails. dont they realize acting like that wont get them anywhere?...............

Relax. You aren't dealing with the pinnacle of the real estate profession here. Well-established, higher-end brokers would not do this. These are the brokers occupying the lower rungs of the profession who have nothing better to do than call you because they have nothing else cooking. Going the FSBO route has many headaches--this is one of them. But then again, you stand to save a lot of money. No pain, no gain.

what would? they're certainly not going to get anywhere by not calling you. as someone above said, they have nothing to lose. no offense, but you chose the fsbo route, as several have said this is one of the downsides.

Also, it's in the interest of the whole profession to make your life hell for bypassing the broker channel. The last thing they want is a bunch of happy sellers running around telling their friends, "I sold my place without a broker, and it went great!"

Even if they don't get a listing, tormenting you is a way of defending their turf and their livelihood. As muscle goes, it's a fairly benign type.

That happened to us too. We put our apartment on the market FSBO ("no brokers please") and got HUNDREDS of phone calls. I was so sick of dealing with them and we did end up caving but did not use anyone who called us. Instead we called someone else who was recommended to us.

In retrospect---our broker got us more than we would have gotten had we stuck with our FSBO, BUT we ended up paying 6 %. I recently read someone's post here where they suggested that FSBO's offer buyer's brokers 4 % and then they will do so much work to get that sale because it's more than the 3% they'd get elsewhere. In retrospect, I wish we tried that before going with the broker.

Brokers are not trying to "torment you". They are calling you because statistically speaking you will give the listing to a broker. They assume that if they call they have a chance while not calling gives them no chance.

Memaria the large brokerage firms have a policy of not taking 4 or 3 percent from an owner furthermore brokers are usually pretty hesitant to bring a client to a FSBO. You are not dealing with a professional on the other side so there is defiantly some apprehension regardless of the commission offered by the "FSBO".

When selling, I would not recommend going the FSBO route, even if you have all of the time in the world to deal with the headache of open houses, unsollicited calls etc. Even if your property is priced well, a significant portion of your potential buyers will be bargain-hunters looking for a deal - it really is a branding / perception issue.

Frankly, all of this talk is nonsense. Brokers will do anything to protect their business, and not dealing with FSBO's is one of them. If sellers could sell by themselves through a governmental listing, that would put brokers out of business.

The NAR is lobbying every state legislature to put laws on the books to continue broker's monopoly on exposure and listings so that you HAVE to use a broker.

I hate them all. If I want to sell myself, let me. If I want to use a broker, fine, but don't control the market.

Agree, this article sums it up. http://www.hauseit.com/best-ways-to-sell-your-home-without-an-agent-in-nyc/ You need to be discreet about being a FSBO and you really need to cobroke in your local interbroker database. Otherwise buyers' agents will ignore you, and unfortunately they do represent over 80% of all buyers .. so gotta engage them !

I love these new selling business models. Someone would have to be insane not to use them. Why for the love of God would you spend 6% for an agent to just list your home. Anyone can do that. That is tens of thousands of dollars! At least eliminate that listing side which is 3%. However until buyers wise up and realize that an agent taking you around is NOT A FREE SERVICE sellers will still have to fork over 2.5-3% for those buyer agents for the near future. But 3% is a whole lot cheaper than 6%.

I love how the brokers say, "the sellers pay the commission," then we showed up to the closing with a big 6% check for Corcoran

er1to9, 9 out of 10 times, a FSBO doesn't end up selling their home. Just look at the sale done by the guy who CREATED FSBO.COM. He tried to sell his own home, by himself and ended up using a BROKER who not only got him more money for him than he would have gotten but put the idea that selling your home by yourself is the best way to save money. What MOST SELLERS don't understand is how to vet a buyer, know if they will pass the board, be able to put the board package together, be available for any and all showings, know how to stage their apartment and show it in it's best light.
