Broker Ethics: selling a 1 bdrm as a 2 bdrm

Can a broker list a 1 bedroom as a 2 bedroom if the second 'bedroom' wasn't filed and does not meet the legal definition of a bedroom? I'm in buying negotiations for a '2 bedroom' trying to get a credit to make the apartment a real two bedroom. The broker claims she didn't list it as a 2 bedroom because in the description it says "oversized one bedroom, (currently being used as a two bedroom)", but it is listed as a 2 bedroom ie if you search for a 2 bedroom it comes up. It is also priced as a 2 bedroom. What are the ethics behind listing something like this?

What the heck does ethics have to do with anything? Do you and the seller go to the same church, temple, mosque, meditation lounge at the airport or otherwise and answer to the same priest, rabbi, imam, or gate agent? If you don't have the same god(s), don't focus on the other party's ethics. Focus on the facts.

I agree with fildschester. Focus on the facts. If you saw a floorplan and visited the apartment, then you knew what you were buying.

As a negotiating strategy, it's perfectly fine to use one bedrooms as comps or discuss the price of converting to "a real two bedroom", but don't play naive. You knew what you were buying when you started the negotiation--it doesn't seem like there was a bait-and-switch scheme here.

sC... you are trusting a salesperson to be ethical? C'mon their whole career is based on some form of deception so they can "always be closing!!!!"

Thanks everyone. I'll focus on the pricing as a 2 bedroom. I guess I was wondering if REBNY had any standards brokers have to abide by, but I'm going to go with no. For the record, I could see the room was on the small side, I didn't know it was so small it couldn't be filed as bedroom.

priced like a two bedroom. What does that mean? Who cares how many or how few walls there are inside the apartment. There are comparable properties in the same building and in similar buildings that negate the subdivisions of the property. Screw the listing and negotiate for the property at hand and stop being distracted by irrelevant nonsense. Call it what ever you want, 1 bedroom, 2 bedroom, 3bedroom...it does not make a difference.
