Move Out Walkthrough/Inspection

Discussion about
If I am a landlord, do I perform a move-out inspection in the presence of the tenants? Or do I perform the inspection individually after they leave? If there are problems, I would obviously ask them to come back to the apartment to settle face to face. How do landlords/renters do it in NYC? 2nd question - just in case my tenant refuses to leave after their lease ends without letting me know, am I able to go into the apartment after their lease ends to see if they've left or do I still need to give them notice?

If they stay after their lease ends without paying, you have a right to evict them through the normal court procedure but there is no self-help eviction allowed, so no you can't just enter the apartment with no notice. (If they pay and you accept it you will be deemed to have entered a month to month tenancy agreement).

I am not aware that a move out inspection is required to be done in the presence of the tenants and I have never had a landlord do that with me as a renter.

When I was a renter I would have always preferred a mutual walkthrough, then items can be discussed on the spot. But normal course is inspection after leaving....and there were always bogus things eating in my security deposit that weren't worth fighting for after the fact.

Even as a landlord, a mutual walkthrough and settling things on the spot seems preferable to going backwards and forwards on any issues discovered.

As a renter, I've had it done both ways.
