Does anyone know if there have been any successful lawsuits where condo owners sued the developer and forced them to properly redo ceilings or floors in order to meet the IIC standard required by the state? I'm not they type to sue and certainly not something I initially think of, but I recently bought a condo and spent my life savings on it thinking it will be my family's home for quite some time to come. it's new construction and I'm very happy with everything. That is until the upstairs neighbors moved in. i can hear them walking from one side of the apartment to the . other. Sometimes they drop something and I'm jolted. I've been woken up several time due to loud walking as they have no carpets yet. Even when they get carpets, I highly doubt it'll make much difference. What really gets under my skin is that after reading extensively on how to properly treat the floors and ceilings below I realize it's not even hard to take these extra steps and not too much more expensive. I feel naive and ripped off. Is it worth getting the test and holding them accountable to meet these standards? They should meet that standard whether someone decided to put carpet down or not seeing as the 70%/80% carpet is not actually law. Any experience on this? [less]
