DOB objection: Proving unit is not rent-controlled

We purchased a one bedroom in a Sunnyside co-op to gut renovate. Our remaining objection from the Queens DOB is proving our unit is not rent-controlled. Despite sending a letter from the property managing agent confirming our unit is a co-op, the DOB refuses to believe the unit isn't rent-controlled. Has anyone experienced this with the DOB?

I have not had this experience with the DOB.

But you may want to call the Metropolitan Council. on housing and ask them how to find out if an apt. Is rent controlled. Or call the DHCR.

Is it possible that your apartment was a sponsor unit which previously had a rent controlled tenant? Even though actually a coop there might have been a tenant in place. The managing agent should be able to give you the unit history
