Discussion about 11 West 81st Street #PHC
First time I've seen a Compass floor plan which was legible and logical. Excelsior!

Tenement House Law of 1901 required additional rooms to be at least 70 sq ft but did not specify the least horizontal dimension. (Sect. 70 "Rooms, size of." Chap. 334/1901 as amended by Chap. 555/1901.)

By 1919, an additional requirement of a 7-foot least horizontal dimension was included. (Sect. 64 "Rooms, size of." (Chapter 61 of the Consolidated Laws of New York as amended up to and including Chap. 648/1919.)

8' least dimension did not come about until MDL of 1929 (Sect 31 "Size of rooms." of MDL)

So, the room seems kosher to me.

Yes, but doesn’t that look like a post-1929 rooftop addition? Or does the original construction date hold precedent?

It's an interesting question. I looked at the LPC report for the district and the HPD Icard for the building. LPC did not note any major alterations, such as the addition of a penthouse.

However, HPD had some good information:
In 1917, the building was recorded a 11 stories, each containing one apartment, for a total of 11 apartments (+1 super's apartment in the cellar) but also indicated that there was a 12th floor (the penthouse) that was for "laundry and 2 maids sleeping rooms."
In 1938, the building was recorded as 11 stories + penthouse, with the building now containing two apartments on the 1st and 3 on each of the upper stories, for a total of 35 units. (+1 super's apartment in the cellar.) This is the current configuration.

There is no 1917 floor plan of the penthouse level on the Icard. If one want's the verify the legality of the bedroom in this particular apartment, one should check the relevant application under which the building was modified at that time (ALT 1324/32).

Fascinating. Thanks for the research!

It's actually a nice compact apartment (the BR photos implies that bed is essentially built-in / fitted wall to wall), and the finishes look pretty good. My complaint is the maintenance seems high for a non-high service building.
