Hello all, Wanted to share a situation with everyone for learning and discussion. My wife and I saw a unit with a rooftop terrace so we naturally asked about leaks. The seller agent told us there were no damages from water, however, after our accepted offer we reviewed the meeting notes of the building there was apparently another leak associated with 2020. The seller then admitted this but refused to provide documents related to the leak unless we signed an NDA. At this point, we were pretty weirded out so we decided to withdraw our offer given the lack of transparency. Lastly, the building only provided the meeting minutes in person, so my lawyer had to go there in person to review. (This cost $300 but was well worth it!). Lessons: 1. Always review board meeting minutes. 2. Ask questions in writing prior to making an offer if possible (we initially asked verbally). 3. Keep your guard up? Hate to add this as we genuinely trusted all of the information we were given initially until we came across the meeting minutes. [less]
Good instincts. It’s New York, not the midwest. Keep your guard up and exercise due diligence.
