In 1951 this space was listed as a MEDICAL office on the C of O. I don't believe the C of O was changed with respect to this unit, but that can be easily checked. In 1951 this space was listed as a MEDICAL office on the C of O. I don't believe the C of O was changed with respect to this unit, but that can be easily checked. As medical space, it isn't an "office", its a medical office. A board may agree to permit different uses for a residential unit, but not for a medical unit. In order for one to occupy a medical office, you must be a MD or someone who qualifies to occupy a medical space as per the NYC code. Otherwise, ANYONE (a passerby) can file a complaint with the city and the city will have the occupant removed. You will still own the unit, but you won't be able to occupy it. If you aren't medical personnel and you buy a medical space and the city doesn't permit a change in the C of O, you are out of luck. The board has no say in a circumstance like this, it is city law. The Board can permit a change in the C of O if the city allows it, otherwise it is a medical office, not an office. In other building's the owner/shareholder was permitted to apply to change the C of O prior to selling which is better for everyone. The buyer has to be an owner before they can apply for a C of O change which is risky even if the board allows it because the city may not. The corporation is allowed to buy and repurpose the space for the corporation's use only, without changing the C of O. The corporation could make it bicycle and stroller storage . The superintendents apartment is zoned as a medical space which is perfectly legal and a great example of the board legally repurposing a medical unit. [less]
