OK, so my friend's D and roommates are thinking about not continuing their new lease for a NYC apt. coming up July 2013. LL has kept them waiting for a new lease, verbally agreed to the lease with an increase. But now, without a new lease for them to sign yet, kids want to move onto a bigger space for the same amount as new increased rent. They have no problem with paying for this last month of rent but they are concerned about LL taking the security $ (one month rent) that they paid at the beginning of the current lease. I don't have a copy of the lease but what is the standard policy in all this? Give 30 days notice or forfeit security $ (it is a substantial amount of money). By the way, for some fluke reason, LL has not gotten this month's rent check sent to him already so he has asked to get a second check (and have first check cancelled). My and friend's experiences with LLs have shown that it is hard to get $ back from the LLs that they have received in this part of town that seems to take advantage of the college crowd. What is your advice? Make out the second check or not? Thanks in advance. [less]
Assuming this is a normal check (as opposed to a cashier's / bank check), you can place a stop payment on it to cancel it. Once the bank confirms that this has gone through, writing a second check is fine if you are intending for just one of the two to get cashed. Obviously, confirm the procedures with your bank.
Right now the landlord has a tenant who hasn't paid the rent and has stated that he/ they want to renew, but doesn't know yet that the tenants have changed their mind on the renewal.
I'm struggling to see where the landlord has done anything wrong to warrant the tenants taking aggressive adverse action and not being upfront.
What neighborhood is this in?

Everyone always says it's a disaster to not pay the last month's rent, but I didn't do it and I got a full refund of our security deposit (because our rent had decreased our deposit was higher than the rent). And we painted our walls non-neutral colors and had lots of wear and tear because we had young children around.
Thanks for the input. Friend knows about stopping payment (with a fee by the bank, of course).
Greensdale, agree with your analysis, just that friend, I and others in our group have met up with unscrupulous landlords who have taken our kids' (our) deposits and run away with $ even when a formal lease has not been signed.
Friend expects not to get back security $ (I also believe the security $ is gone, with or without the 30 day notice.) That is the way it seems business is conducted. Once $ is transferred over to the LL, GL getting back $ even if the $ should be rightfully returned, say, minus some minor repairs, and even with 30 day notice.
It looks like friend's D will re-send second check. So, we discussed doing the "right" thing despite knowing that the over $5000 in security will likely not be returned to the parents of the kids.

Large hard-ass landlord, no issues despite everyone swearing that not paying last month will destroy everything, including credit. Bullshit.
You're not even thirty days past due. There's no way they could report you to a credit bureau for simply not paying the last month's rent.

You are right. There was some concern about the effect on friend's credit (being the guarantor). Your perspective is a different one from
just paying up even when tenants know they will have trouble getting security money back.

See below, you didn't pay your last month, and it sounds like you feel you got away with something.
No, I didn't owe anything. They still had more than a thousand dollars in security after rent. If they could have legitimately proven damages beyond normal wear in excess of the remaining deposit I would have paid them. But they returned the balance to me. You are an asshole who looks for the worst in everything. Such rampant negativity must be hard to live with, even for a person with as little integrity as you.

You misinterpret. Not smug, factual. It occurred, large landlord had zero issue with it. Simply reporting that despite the dire warnings often given here, it can and is done. Quit being such a shithead and thinking the worst about everyone. It would be good for your soul, you sanctimonious asshole.

I assume you sleep well at night by counting all of the people from whom you've gotten the upper hand.
If the landlord hasn't given them a lease to sign then the agreement ends at its term (this is meant as practical advice not legal advice). If he gives them grief on the security deposit, they should do what they would do any other time and take the landlord to small claims court.

And, fresh direct sent me some horribly bruised bananas. I sent them an e-mail, they apologized and gave me a credit. I'm sure for some reason that others you, just like my asking a landlord for a new toilet seat. Things that are totally acceptable and normative.

Of course, good customer service. Which was my point when I made the initial comment about bananas. People don't trust other people selecting produce and meat. They want to see it. Which s why FD has such a lenient policy. But that was too nuanced for you. Yet again you have o assume the worst. What a burdensome existence.
