Application Fee Concern

Hello, Apologies as this question has probably been addressed before but I didn't find it... Is it ethical/legal/appropriate for an agent on a no fee apt (exclusive for the building) to take an a $95 application fee at the same time from two different people (I am one of them) when they know one of the people (if not both) will not get the place? Wouldn't it be better to process the first person who applied first, then if that person is not accepted, go to the next person on the list? Thanks!
