Non condo owner/non deed holder run for condo board in NYC?

I posted this question on brownstoner forum but realized that it was probablely a poor choice compared to here. So, the question. Can a non-owner and non-deed holder run and be a member of a condo board in NYC? In this example, a family member bought a condo for another family member. They both share the same last name. The buyer and owner and deed holder does not live in the building but the family member it was bought for does. Is the person now living in the building considered an owner and can this person run for condo board? I realize that anything is possible if in the condo by-laws but in general, is this common in NYC? Has anyone heard examples for or against this?

First place to look is the Condo bylaws. If you are an owner you have access to this.

every building will be different but the idea of having a tenant (however long-standing) on the board sounds weird to me. I would guess that with most buildings, if the family wants representation, then the absentee owner would be welcome to run for the board.

I don't know of any off the top of my head. If you couldn't, it would be hell for Sponsors. And I'm not sure it's even an Offering Plan issue, it might be General Association Law, Condoinium Act or BCL isssue?

fyi, it's happening in my west side building right now. Son of owner is running for the board.

I was just checking my offering plans by-laws regarding board member qualifications and I can't decifier the legalize speak!

It is a good question. In my building there is a rude, obnoxious old lady on the board but she isn't an owner. Her son bought the place for her and now I wonder if she isn't even supposed to be on the board!
