Discussion about 95 Wall Street in Financial District
Dwell95? You must mean Hell95. Dwell95? You must mean Hell95. This luxury apartment building may lure you in with it's cute leasing associates, celebrity tenants, intoxicating music and mesmerizing decor but do not be fooled by all of this. When a pipe burst on the floor above me, it destroyed and damaged numerous belongings of mine including computers, carpets, furniture, and a mattress (I could go on and on); I was compensated for nothing and treated like absolute crap by management. For a month I was living in a temporary apartment without a working stove or freezer. In any other situation I would deal, but you have to remember, my roommate and I pay over $3,000 for rent to live in a studio apartment! I expect to get what I pay for! No one contacted me to keep me informed about the status of my flooded apartment or when we should expect to move back in. I wrote them a letter voicing my concerns and more than 2 weeks later without hearing a word from them (apparently they are not familiar with business etiquette) I had to call repeatedly to solicit a response in which they told me I lied about what I had written in my letter. I wonder what would happen if Chace Crawfords pent house apartment was affected by this? How much *ss kissing would management be doing? I am certain they would not tell him to sleep on the floor or slam the door in his face, like they did to me. [less]

Didn't renter's insurance cover damages? What does lease say as to liability of landlord in case of flood? I assume you photographed everything and got things in writing from landlord about apartment switch and what the plan is. That should make what is true and what is a lie pretty clear. What about small claims court (or is there something in lease you signed that bars this)?
My roommate and I do not have renters insurance. We did take pictures of both our flooded apartment and the temporary apartment they placed us in. I'm not familiar with what the lease says about small claims court. I am aware the lease states that if the apartment becomes unusable in part or totally that rent will be reduced immediately but that has yet to happen.
First, PLEASE get renters insurance. It is dirt cheap and unfortunately you know all too well how important it can be. Second, your lease contains many provisions that are probably relevant. If the landlord provides a comparable dwelling it is unlikely you are entitled to anything back. You have to read the lease. If you've been suffering the aftermath of the flood for a full month, it is frankly a little surprising you don't know exactly what the lease says in terms of what should be happening. You can't just read one paragraph. Many may interact together. Boring as it is, sit down and go through it and what you don't understand you should ask a friend to help you with (esp. on who is a lawyer).
