Basically I signed with a broker 2 months ago for a 6 month term.At this point the apartment is not listed anywhere hasnt been in the paper and you would not know it was for sale because its not listed or marketed outside the building..I have complained but to no avail.So Im just waiting for the contract to run out.My suggestion to anyone selling any real estate in New york do not go with an independent broker unless you have explicit marketing plan in the contract or use one of the big firms because at least I see they market their clients property in many venues.
I would suggest going to court to void the deal. Every contract in NY State has an implied duty of good faith. If he/she is not marketing in good faith, you can have the contract voided.
i would report him/her to the real estate board that issues the brokers license. That is outrageous. Does he not have a web site where his listings are displayed??
It sounds like you can void the contract as the broker is not making a good faith effort to move the apartment.
I would never sign a 6 month listing contract. I like 3 months with right to cancel afterward. Unless you work with the broker before, you never know how it turns out. I assume you had a heart to heart talk with the broker, and expressed your concerns. I hope the apartment is at least on the Manhattan MLS system.
Cancel the contract immediately and do not waste 6 months with someone who is not marketing your property. Send the broker and or owner/manager a written explanation about why you want to cancel the agreement. I believe web advertising to be crucial while print ads are not as important. Your apartment should be listed on all the major sites such as Zillow, Natefind, Trulio, StreetEasy, NYtimes.com, and a major real estate site like elliman.com.
