does the spa's pullout give owners or those in contract a valid legal reason to seek redress from the developers?

Probably not unless they specifically named and guaranteed the spa in the contract, which i highly doubt.
Most condo plans read as a here is all, but it may not happen. There are risk pages up front listing all that may go wrong.
Even the 421-a which i am still waiting to become effective in my building is no guarantee. They put in all the legal opinions showing they qualify, but even that has a caveate saying it may not happen.

building will be a luxury rental after no one continues to buy......
