Discussion about
Can anyone recommend a truly excellent real estate tax certiorari attorney to contest the tax assessment for a multi-family rental building? I'm working with a building that is being truly reamed by the city. (Yes, I know it's bad all over, but even relative to other over-taxed multi-family buildings, this one has it bad. It's so bad that an independent appraiser refused to underwrite it using the actual taxes, because he insisted that they were implausible.) The attorneys we've tried so far seem to work on a high-volume, low-attention basis, and they've returned lackluster results.

Have you tried Goldberg Weprin @ 1501 B'way; 212-221-5700? They do a lot of RE tax Cert.

Has the bld been challenging RE assessment every year? Cause, it's not a one shot thing, ya have to file every year to keep taxes down.

The other thing is that, IMO, due to fiscal shortfalls, municipalities are going to squeeeeeze the hell out of RE for taxes. So, even if income decreases, assessments go up. RE is a sitting duck: Can't move the bld to a lower tax location.

Also, IMO, I think courts are inclined to favor municipalities over property owners in order to give the city more income. Additionally, in view of the recent trend of eminent domain cases, courts have diminished the rights of property owners: ie: a municipality can take private property so that private developers can create shopping malls. Why? Because a shopping mall generates more tax revenue for a municipality that a private residential owner. Sorry, I digress. This is not to say that you won't lower the assessment, I'm just commenting on the trend.

Nonetheless, go for it & file, quickly because the filing deadline is looming: http://www.nyc.gov/html/dof/html/property/property_val_valuation.shtml

Good luck

Did they fail to file RPIE & were punished by city imposing mega taxes?
