Discussion about
Can anyone recommend a good and reliable Title Search company? Don't need title insurance just want the search done since this is a transfer deed after a parents death and the child wants to make sure that there are no issues.
If you're an attorney and you're advising against title insurance, I hope you're good at tending the other kind of bar. And if you're a friend of somebody "helping" them out, beware of practicing law without a license. If things go awry you could experience a life-changing event.
As the child I would want title insurance because things come up. I once collected $7000 from a title insurance policy because a lien was overlooked on a residential property I purchased. That was quite the return on investment.
Do the smart thing and spring for the title insurance. American Title Company. If the child is too broke for title insurance, how is this child going to be able to afford property taxes anywhere in the metro NYC area?
Penny wise and pound foolish, my gramma would call your plan.
kharby:
1. I have bought property without title insurance and will continue to do so
2. 97% of title insurance fees go to administrative expense, sales and profit
3. generally all you need is prior owners title report and current tax searches
It's foolish to buy insurance is you can self-insure. If you can afford to lose a substantial sum in the event of a title problem, then insurance is a waste of money for you. Most people are not in that category.
In the state of New York we rely upon title insurance to protect ourselves as purchasers. And it's not expensive. Other states do things differently, but this is how we do things here.
Sometimes people will say, lawyers even will say, "I never heard of anybody getting paid from a title insurance policy." Well, of course not, duh, because the attorney is long gone by the time the purchaser collects on the policy. This stuff can show up months or years post closing. The purchaser doesn't contact the attorney, because they will be referred to their title insurance company pretty quick. I personally know several people who have collected on title insurance, in addition to my own experience.
There are thousands of closings a year, handled by paralegals with various degrees of competence and care. To assume that no clerical mistakes are made, or that any mistakes made are financially insignificant to the purchaser, is just more risk than many people would comfortably take on, if they fully understood the process and potential issues.
such a ripoff--you pay "experts" to search/research title on a property, and then buy insurance from them to cover losses that might result from their poor research--
Here's a question: can you get title insurance with different deductibles? Say you want anything over $10,000 (up to and including a claim of actual ownership) to be covered/defended but are willing to self-insure for the overlooked $7000 lien.

I have worked extensively with both companies on Purchases and Refinances; they both provide exceptional service at very reasonable fees.

I recently purchased title insurance from Title Vest while buying an apartment and they "misplaced" all the papers they were suppose to submit! The aggressive pro title insurance comments above smell fishy to me and the whole Title insurance business model smells like fishy business to me.
