Here's another lot-line story. These buyers somehow imagined that nothing would go up on the vacant lot next door to the west. Something, of course, did, and now they're trying to get access to their south lot line to put in a window. And there's more. The buyers sued their lawyer and appraiser for malpractice, saying they should've noticed the big black "Special Risks" notice in the offering plan about the lot-line windows: https://iapps.courts.state.ny.us/fbem/DocumentDisplayServlet?documentId=R02mkUp0ktgVOP38DwAOXw==&system=prod

They later dropped that case.

Now I see what you mean, but it didn't ring a bell at the time. I'd just been searching eCourts for parties with "Tenants" or "Owners" in their names, and this turned up.

They lost their case against the building to the south, pleading for access to put another window in. They're appealing that decision.

As if that wasn't enough litigation hell for one couple, she's also been in court for the last three years trying to get more commission money from her former employer.

NWT:

1. in the late 1980's I lived in a building whose window faced a being built hi-rise
2. I researched the issues of easements for air and light

3. NY law didn't recognize them at that time
4. so builder had right to block my window
