Can a landlord offer a lease three months in advance and then indicate that they plan to raise your rent over $400 if you don't sign before the end of the month? I am annoyed that they have done this. I have asked them to show me comparable properties and they haven't responded. This property exists over the 2nd avenue subway construction.

assuming your lease is not rent stabilized they can do this - and they have no obligation to show you comps - fwiw - i wouldn't push them to show you comps - I'd never renew a lease to a tenant who was pushing on something like that.

"Comps" are not a legally binding measure of how much (or how little) a landlord can charge in rent or the selling price of a home.

They are merely a guide.

If you're not subject to stabilization laws, the landlord can charge you a million bucks a month if he so chooses. And you have the choice to either comply or move.

Landlord could have said your rent is going up 400. However, you are a good tenant and we are interested in keeping you, so if you want to stay and tell us early (this month) we won't ask for the full 400 more and will give you a break on the increase.

3 months is not that far in advance anyway. What is the minimum time they are offering for the renewal at the 400 increase?

There may be some " 2nd avenue subway construction" exception to free market apartments.
