Discussion about
Someone I know, not a client, has been unable to obtain his $500 move-out deposit at and after the closing. Management company is quite large, and they don't seem to care whatsoever. He can definitely survive without $500, but for him it is a matter of principle as he feels like he is getting screwed. What would be the appropriate next step?

Small claims court or your bank. It took 3 months for me to get my move-out deposit back from a condo. They claimed they didn't get the report from the super in a timely fashion.

Thank you, JJ2 and jelj13. I'd appreciate a couple more suggestions, please.

You should also find out why the deposit wasn't returned. They have to provide a very good reason to not return a deposit immediately.

nasty letter from lawyer sent to both management company and the building's board would seem to be the next step and likely to work one way or the other to shake out the $500.

Clear, concise letter, not "nasty", not from a lawyer (save yourself the money, you know how to write a letter yourself). 30 days, then Small Claims Court.

Yes do what Flatsbridge says. Nice letter from YOU. You have to mail these things, phone calls are like it never happened, you have to WRITE AND MAIL. Small claims court is Easy, Cheap and FUN! I love going there, I win every time so I'm cocky. You can file small claims on line in NYC, don't forget to ask for your $35 filing fee back. It's fun to watch the judge scold the other party, you'll love it.
