Is it a real 2BR??

We've been seeing a bunch of listings for 2BR duplex apartments with patios in townhouses on the UES and UWS... Here's the question, is a groundfloor duplex a true 2 bedroom if the second apartment is below the entry ground and has lower ceilings? Does it make a difference if the garden is off the bottom floor, ie there is light down there? Or are these 1BR that are being passed as 2?? Thanks
