I have been "subletting" an apartment for the last 6 months. I have been "subletting" an apartment for the last 6 months. I put "subletting" in quotes because althought everyone called it a sublet and the management company is still holding onto the prime tenant's security deposit, I am being treated more like an assignee. E.g., I make my payments directly to the management company and I make maintenance requests directly to the staff. In any event, both the "sublease" and the prime lease runs out at the end of this month. About a month ago I told the management company I was interested in applying for my own lease once the prime lease was up. The management company sent me the application, which for one reason or another, I sat on until this week. I did, however, send in my paperwork this week. I have not heard back a response. Understandably these things take a few days to process, etc.; however, I am worried they will not be done by end of the month. Yet, neither do I plan to move out at the end of the month. (Financially, there is no reason I would not be approved.) What could/should occur if by the end of the month I have not signed my own lease? Can actions be taken against the prime tenant (which I absolutley do not want to happen!)? [less]
I should add that when the super asked me last Friday that he and the owner were coming to look at the apartment this week to see what, if any, renovations needed to be done once I moved out, I told him that I was planning to stay and that I just hadn't gotten my application into the management company. He liked the idea of me staying and said that was great. He and the owner (yes, the actual owner of the building), came to see the apartment this week, and the super told me what they needed to do. I told him that I was going to be on vacation the first week of March, so he could do whatever he wanted to then without me being in the way. He agreed. I assumed this means that at least SOMEBODY and maybe even the owner knows that I am staying.
Why sit around worrying? Call the management company and ask them what the status is. And inform them you haven't made any arrangements to move out so if they have any issue giving you the lease they need to let you know immediately. Don't assume the super is communicating things correctly to you or will relay what you told him to the management company or has any authority in the matter whatsoever.
I believe management needs to give 30 days notice to cancel a lease or else it rolls to month-to-month.
