Uncooperative owner of empty condo unit

Hey guys, what happens when a condo unit is vacant (the owner is also non-responsive and uncooperative) and something bad happens that would cause a DOB violation? Who is responsible? Will the DOB or local agencies fine the building or the condo owner? Even though the building can't get access to the unit? There's a common charge lien on the unit already.

The DOB would likely fine the building- not the unit owner. Common Charge lien protects the building in the creditor process, but does little to solve anything by itself. If there is some vital need to gain access to the apartment- (i.e. plumbing issue, etc) - the building has the right to access the space. This should be coordinated with the manaing agent.

How about telling us what the "something bad" is that would cause a building violation? I am having trouble thinking of something that would cause building violation just because the unit is empty.
