Discussion about
We have an owner in our condo who has caused various issues with guest/smoking/noise violations. Recently he was caught on security camera spray painting graffiti onto the sidewalk entrance to building, plus the street. The graffiti is his own name, so it would have been hard to refute even without camera. Any experience with dealing with an owner like this in a condo? What kind of actions can the board take? Sternly written letters are clearly not doing the trick.
Time to call in the lawyers and prepare for eviction proceedings.
Since it is an owner in a condo, you need to get a lawyer to manage this process. I can't give legal advice as I am not an attorney, but I imagine this will be in incremental steps. The attorney will send some lettters, perhaps with fines attached. If not response, then likely a lien on the apartment, if still no response, the condo can pursue a money judgement- which is faster, easier, cheaper than a foreclosure. If pursuing a money judgement is not worthwhile in your situation, then the board would pursue a common charge lien foreclosure- which can take 1-6 years. If you foreclose and the owner refuses to leave- then you prepare for eviction proceedings.
My building is foreclosing on a unit owner- and we are 4+ years into the foreclosure filing. We hope to have this wrapped up in another year. The courts are backlogged and they are pro-individual owner. The condo might not be awarded a large portion of the building's legal fees. We had the additional complication of a judge that was handling our case was demoted causing an additional year delay.
Graffiti should be reported to the Police so that he is on the record for misdemeanor or fine. Lawyer will deal with the rest. Not much you can do about noise etc.
